1. Who we are
TiwariTec is the trading name used by founders Shubham Tiwari and Aditya Akshat, based in Dehradun, Uttarakhand, India. TiwariTec is not a registered company. We provide website development, application development and AI agent integration services.
Contact: tiwaritec7@gmail.com. Each project agreement will identify the contracting service provider and their contact address.
2. Project agreements
Sending an enquiry does not create an obligation to buy our services. Before starting a project, we agree in writing on the scope, deliverables, price, payment schedule, estimated timeline and any included support.
These service terms form part of a project agreement only when provided to and accepted by the client. Any specifically agreed project terms take priority over conflicting general terms, subject to applicable law.
3. Pricing and payments
Our standard payment schedule is 50% of the agreed project fee in advance and the remaining 50% before deployment. Payments are arranged separately. This website does not collect or process payments.
The proposal will specify the currency, applicable taxes, included services and any separate costs. Hosting, domains, paid software, AI usage and third-party subscriptions are included only where stated in the proposal.
Before the final payment becomes due, we will provide an opportunity to review the agreed deliverables through a preview, demonstration or other agreed review method. Outstanding work within the agreed scope will be addressed according to the project agreement.
4. Scope changes and revisions
The project agreement specifies included features and revisions. Additional features or changes outside that scope may affect the price and timeline. We will explain those changes and obtain written agreement before carrying out additional chargeable work.
5. Client responsibilities and timelines
Clients must provide accurate requirements, necessary content, authorised access and timely feedback. Clients must have permission to use the materials and data they supply. Passwords and other sensitive credentials should be shared through an agreed secure method.
Delivery estimates depend on the agreed scope, client feedback and external dependencies. If a delay occurs, we will explain its effect and discuss a revised schedule. Changes to an agreed deadline require agreement between both parties.
6. Cancellation and refunds
You may request cancellation by emailing tiwaritec7@gmail.com.
If you cancel, we will calculate the amount due for work actually completed and reasonable, non-recoverable expenses that you approved in advance. Completed work will be valued using agreed milestones or rates, without double-counting. We will provide an itemised explanation and refund any unused advance.
The advance is not automatically forfeited. If work has not started and no approved non-recoverable expenses have been incurred, it will be refunded in full.
If we cancel, we will refund payments covering unfinished work and provide any completed deliverables for which payment is retained, subject to applicable licences. This does not limit any additional remedy available under applicable law.
We will communicate the refund amount and processing date promptly. Any statutory refund deadline takes priority. Cancellation does not remove rights relating to defective, incomplete or improperly supplied services.
7. Consumer cancellation rights
If you are acting as a consumer and applicable law gives you a cooling-off period, withdrawal right or other mandatory protection, that protection takes priority over these terms.
Where required, we will provide the relevant withdrawal information and obtain a separate express request before starting services during a withdrawal period. Accepting these terms alone does not waive those rights. Any charge for work during that period will be limited to what applicable law permits.
8. Ownership and licences
You retain ownership of materials you supply. You give us permission to use them as needed to complete the project.
The project agreement will specify ownership or licensing of custom deliverables, source-code handover and when those rights take effect. Any copyright assignment must be recorded in the required written agreement.
Pre-existing tools, reusable components, open-source software and third-party assets remain subject to their respective ownership and licence terms. We will identify relevant restrictions and recurring licence costs.
We will obtain your permission before displaying private project details or using your name or logo in our portfolio.
9. Third-party services and AI integrations
Projects may depend on hosting providers, app stores, messaging platforms, payment providers or AI services. Their availability, approval processes, pricing and terms may affect the project. Relevant dependencies and costs will be discussed before integration.
AI systems can produce incorrect or incomplete responses. AI receptionist and booking projects require agreed rules, testing, human escalation and appropriate data safeguards. They are not intended for emergency services or unsupervised decisions requiring professional judgement.
These limitations do not remove our responsibility to perform the agreed services with reasonable care and skill.
10. Confidentiality and personal data
Both parties must protect confidential information received for the project and use it only for authorised purposes, except where disclosure is required by law.
Our Privacy Policy explains how we handle website enquiries. If a project involves processing personal data on a client's behalf, the parties will agree on the necessary processing instructions, security measures and data-processing terms before that processing begins.
11. Support and maintenance
The proposal will specify any included support period, maintenance, backups, updates and response commitments. Continuing support is included only as agreed in writing. This does not limit mandatory rights relating to faulty services.
12. Acceptable use
You must not use this website or our services for unlawful activity, fraud, infringement, unauthorised access, malware distribution or misuse of personal information.
We may decline unlawful work. Where a project must be suspended or ended, we will explain the reason where legally permitted and account for payments and completed work fairly.
13. Responsibility
We will provide services with reasonable care and skill. We do not promise specific sales, search rankings, revenue or uninterrupted operation of external platforms.
Nothing in these terms excludes liability for fraud or any liability that cannot lawfully be excluded or limited. Any project-specific liability provisions must be separately agreed and comply with applicable law.
14. Complaints and applicable law
Please send project concerns to tiwaritec7@gmail.com with enough detail for us to investigate and discuss a resolution. Contacting us does not prevent you from exercising legal rights.
Unless otherwise agreed in a lawful project contract, Indian law governs the agreement. This does not deprive consumers of mandatory protections or access to courts, regulators or dispute-resolution bodies available under applicable law.
15. Changes to these terms
We may update these terms for future engagements and will revise the date shown above. Updates do not retrospectively change an existing project agreement without the parties' agreement, except where required by law.
